Catt Division Director <br />or <br />Natural Resource Trustee <br />Re: Last Chance Mine, File No. M-2008-012, Amendment (AM-01) 112d(1), Designated Mining <br />Operation Application, Decision Date Approaching. <br />Dear Mr. Carter: <br />The Division of Reclamation Mining and Safety (DRMS) received Nuvemco's amendment / conversion to the <br />application of the above referenced 110(2) application on April 13, 2009. The application is now for a 112d <br />(1) permit. Nuvemco requested that the decision date be extended to February 1, 2010 due to unforeseen <br />economic circumstances. DRMS accepted the request with the understanding that should conditions improve <br />prior to that date Nuvemco would be submitting updated information with a request to proceed with the review. <br />Staff notes the decision date is near and has not received any correspondence in regard to the permit since the <br />extension was granted in July. At this point Division staff would be unlikely be able to review the amendment <br />and responses submitted in regard to the amendment which includes an Environmental Protection Plan. The <br />Division is requesting Nuvemco extend the decision date until April 15, 2010. Please be aware that per Rule <br />1.4.1(9) the application process must be completed within 365 days of being called complete or it shall be <br />scheduled for a review by the Mined Land Reclamation Board. The 365 day limit is April 15, 2010. <br />To ensure that a Board hearing does not occur, DRMS must have any updated information in hand no later than <br />February 12, 2010. A review of the application will be done in mid-February and responses will be required by <br />March 19th. A cursory review of the application notes no proof of publication. Please provide the proof of <br />publication as required by Rule 1.6 (1) (d) as soon as possible.
