P??,F,N1' OR T <br />QP .-?lf? ? yF,-, <br />'C6 <br />'11g9C? <br />January 19, 2010 <br />United States Department of the Interior <br />OFFICE OF SURFACE MINING <br />Reclamation and Enforcement <br />Western Region Office <br />1999 Broadway, Suite 3320 <br />Denver, CO 80202-3050 <br />SN`EN?OF <br />RECeD <br />Loretta Pineda, Acting Director JAN 19 2010 <br />Division of Reclamation, Mining and Safety Division oT rteckmmuon, <br />1313 Sherman Street, Room 215 Mining and Safety <br />Denver, CO 80202 <br />RE: Partial Phase I, II, and III Bond Release (SL-6), North Thompson Creek Mine <br />Permit No. C-81-025, DRMS Proposed Decision and Findings of Compliance <br />Dear Ms. Pineda, <br />This letter acknowledges the Office of Surface Mining (OSM), Denver Field Division's (DFD) <br />receipt and review of the above Phase I, II, and III Bond Release Proposed Decision document <br />prepared by the Division of Reclamation, Mining and Safety (DRMS) dated December 22, 2009. <br />DFD agrees with the findings and decision document and hereby provides OSM concurrence for <br />the above bond release action in accordance with 30 CFR 740.15 (d) (3), and 30 CFR 906.30, <br />Article IX, Section 24, of the State-Federal Cooperative Agreement. <br />DRMS's Proposed Decision documents the applicant's compliance with the Colorado approved <br />regulatory program at Rule 3.03.2, and DRMS's bond release guidelines dated April, 18, 1995. <br />This Phase I, II, and III bond release applies to 0.2 acres consisting of the two flume sites in <br />North Thompson Creek, the two flume sites in Middle Thompson Creek, and piezometer sites D- <br />1 A and D-2A. <br />The mine water treatment system in the Developed Water Resources Area at the North <br />Thompson Creek Mines is not currently eligible to be considered for Phase III bond release. <br />Additionally, the underground mine workings are not currently eligible to be considered for <br />Phase I, II, and III bond release because they are the source of the water that is treated in the <br />mine water treatment system in the Developed Water Resources Area. The Colorado <br />Department of Public Health and Environment's Water Quality Division determined that mine <br />water discharging from the No. 3 Mine does not always meet water quality standards without <br />treatment. DRMS Rule 4.05.2(2) requires that a water quality treatment facility be maintained <br />until either the discharge continuously meets the effluent limitations without treatment, or until <br />the discharge has permanently ceased. <br />OSM finds that MINREC, Inc. has met or exceeded the requirements for Phase I, II, and III bond <br />release on the 0.2 acres of land as described above. DRMS currently holds a performance bond <br />in the amount of $100,000. The current liability amount is $42,115.00. This action will release <br />$32,115.00. DRMS has determined that the remaining bond amount of $10,000 is sufficient to
