<br /> <br />2. What is the difference our property and the property of Ward Burbridge, Tom Garvey, Carl <br />Benson and Goforths? Why do the reclamation standards need to be chaneed for our <br />property? <br />3. Western Fuel has told us that they are required by a governmental agency to file for the water <br />rights for the runoff water on our property. In our lease agreement, we have agreed to the use <br />of our water until reclamation is approved by your agency and the property is released to us. <br />Why should they be required to file for this water and if so, why can it not be only for <br />conditional use until they are done with reclamation? <br />4. The Western Fuel Revision request lists several types of reclamation criteria such as irrigated <br />cropland, irrigated pasture, dryland pasture. What are the differences in reclamation <br />requirements for each of these in (a)depth of top soil. (b) removal of rocks near the surface, <br />(c) deeree of slope? <br />Here are our requests: <br />1. We request that no changes be made to the reclamation standards that are presently in place <br />for the New Horizon Mine 2. Please keep the same standards that have been used on the <br />property being reclaimed closer to the town of Nucla. <br />2. We request that Western Fuel not be required to file for the water rights from the catch basin or <br />pond on the north side of our property near Tuttle Draw. <br />3. We request that before reclamation is complete that the catch basin or pond near Tuttle Draw <br />be removed and that field restored so that it can be used for cropland again. <br />Thank you for your consideration of our requests.
