The SL-4 bond release inspection was conducted on November 3, 2009. As a result of this inspection, it <br />was determined that additional field work needed to be done before the Division could make a proposed <br />decision. Because of winter weather, however, the additional field work can not be finished so SL-4 has <br />been extended until June 30, 2010. The Division calculated a reclamation cost estimate for SL-4 in <br />December of 2009. Because of the closeness in time to the 2010 Midterm, the SL-4 reclamation cost <br />estimate will suffice for the 2010 Midterm Review reclamation cost estimate calculation. <br />No violations were issued between the time of the last renewal and the writing of these 2010 Midterm <br />findings. <br />This Midterm Review is due on January 19, 2010. <br />SECTION 11- REVISIONS TO THE PERMIT <br />Since the Permit Renewal No. 5 Findings document, dated June 22, 2009, there have only been two <br />requests by the Bear Coal Company to revise the Bear No. 3 Mine permit. One request was for a minor <br />revision and the other request was for a Partial Phase One Bond Release. The following is a summary of <br />the revisions to the Bear No. 3 Mine permit. <br />Minor Revisions <br />MR-31 - Amend the Ownership and Control Information <br />- submitted on October 8, 2009 <br />- approved on October 19, 2009 <br />- no bond adjustment <br />- no acreage adjustment <br />Technical Revisions <br />None <br />Permit Revisions <br />None <br />Bond Releases <br />SL-4 - Partial Phase One Bond Release. <br />- submitted August 6, 2009 <br />- field inspection was conducted on November 3, 2009 <br />- proposed decision extended to June 30, 2010 due to outstanding field issues and the <br />onset of winter weather.
