A <br /> I <br /> III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the inspection. Comments also <br /> describe any enforcement actions taken during the inspection and the facts or evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Janet Binns of CDRMS. The mine no longer extracts coal,but the remaining <br /> surface pit(Pit B)is permitted to dispose of flyash. The weather was cool and calm. The mine site was frozen with small <br /> patches of snow throughout the site. Present at the inspection were Don MacDonald and Danny Kipp of Coors Energy <br /> Company. <br /> Signs and Markers: Mine ID sign at the access road entry on to the permit area remains intact and up to date. <br /> Roads: CEC continues to remove road base material from the haul road return from the pit to the facilities. CEC does not <br /> rely on this travel corridor from hauling ash or spoil to the B-pit as the active area in the B pit progresses northward. Road <br /> side ditches along the haul road are in good shape. The access and haul road are in good condition and well graded. <br /> Hydrologic Balance: Pond#2 was dry with patches of snow. No problems were noted with this pond. The Dugout pond <br /> was also dry with small patches of snow. Pit B was dry with infrequent snow patches. <br /> Support Facilities and General Mine Plan Compliance: Oil and gas well development have been recently flagged. Mr. <br /> MacDonald stated that the gas company has decided to conduct directional drilling. Two locations have been staked. The <br /> western pad location will be located in area 21. The hole locations have been flagged but PDC(Oil&gas company)has not <br /> provided CEC with proposed dimensions of the pads or staked the road corridor location. CEC thinks this western pad may <br /> extend beyond the approved Phase Ill bond release area. If affected area will extend beyond the phase III area CEC will <br /> permit this variance in post-mining land use with the Division. Five wells are proposed to be drilled from this location. The <br /> drill holes shall be aligned in a N-S orientation. The second proposed pad is located within the northern portion of Area 3. <br /> Four holes are flagged at this eastern pad,with the holes oriented in an E-W direction. CEC stated that they have informed <br /> PDC not to disturb the copse of trees on the north end of this area. Actual dimensions of the proposed pad have not been <br /> staked or provided to CEC yet. PDC has indicated that it will conduct all the drilling from these two locations so previously <br /> flagged drill pad location most likely will not be disturbed. <br /> The access route CEC uses to access Pit A water well will need to be rerouted based upon final drill pad dimensions and oil <br /> and gas access road routes. <br /> CEC continues to dispose of ash in Pit B. CEC is currently placing ash on the second lift. CEC is hauling 6 truck loads of <br /> ash from the power plant daily at this time. No problems were observed with the pit or the ash disposal area. <br /> Topsoil:No additional topsoil has been replaced since the previous inspection,nor is any planned while soils are frozen. <br /> Reclamation Success: The public comment period for SL4 and SRI was final on January 8,2010. No comments were <br /> received regarding either of these permitting actions. SL4 and SR1 were final at the close of business on January 8,2010. <br /> Some of these phase III release areas are proposed to be re-disturbed by the oil and gas development. <br /> No maintenance problems were noted during this inspection. <br /> Pans 'I of d Pans¢ /natal VlAo inlinifialel ihh <br />
