Examples of defaults which are not <br />the responsibility of any party would be a major unexpected CCC ditch system <br />failure, drought, or other Act of God occurrence beyond the Morgan's control. <br />In such cases, WFC pays for all costs associated with the extension of time to <br />get the bond released. <br />7. Supply fertilizer and bear the expenses of applying the fertilizer to the 71 acres <br />only if the Morgan's opt to fertilize the reference area and the differential <br />area(s). See bullet 4 below. <br />In exchange, the Morgan's, at their own expense, will: <br />Furnish additional CCC irrigation water shares (above and beyond the original <br />50 shares) to adequately water the remaining irrigated alfalfa crop acreage to <br />the level needed to meet Reclamation Bond release production. This additional <br />water amount is to be determined by the NRCS calculations and the DRMS <br />concurrence. <br />2. Furnish all the labor and necessary irrigation equipment to properly irrigate the <br />acreage difference between the total (112 acres more or less) and the 71 acres <br />(or the final acreage approved by DRMS) identified in Bullet 3 above under <br />WFC's proposed obligations and at the rate NRCS prescribes to grow Alfalfa <br />to the prescribed production levels in their 2009 calculations. <br />3. Manage the Irrigated Alfalfa Reference Area using the same water rates and management <br />levels as the reclaimed Irrigated Alfalfa land and will allow WFC or WFC's contractor to <br />sample the Reference Area as required by DRMS. <br />4. Have the option to add fertilizer each year to the reference area and the differential area <br />as they wish and will bear the expenses for any fertilization and application cost for the <br />differential acreage and the reference area. The differential acreage means the total <br />Morgan owned irrigated acreage in the permit area ( 112 acres more or less) less the 71 <br />acres that WFC is providing fertilizer for. This is approximately 112 - 71 = 41 acres. <br />WFC will pay for the fertilizer and application cost for the first 71 acres only if the <br />Morgan's have elected to fertilize the other parcels. Morgans will agree to fertilize the <br />differential area and the reference area, using the same application rates at the same time <br />as the fertilizer is applied to the other reclaimed alfalfa area. <br />5. Allow WFC the use of 23.6 acres (more or less) of land planted as Irrigated Alfalfa Crop <br />to be used as a Reclamation Revegetation Reference Area for Reclamation Bond <br />vegetation performance/comparison purposes. This parcel is generally located in the <br />SW 1/4 of the NW 1/4 of Section 1, T46N, R15W of the N.M.P.M. Any normal <br />husbandry practices such as reseeding of the field to rejuvenate an aging alfalfa crop will <br />be coordinated with WFC.
