Cattany
Division Director
Natural Resource Trustee
Re: Ophir Lode, Permit M-2001-063, Request for Technical Revision (TR-01), Weed Control Plan.
Dear Mr. Giesy,
I have received your letter dated 1/8/10, and the copy of J. Barry Custom Weed Control Inc.'s letter stating
his agreement to treat the noxious weeds on the permit area in August 2010. These two items were
submitted toward filing a new technical revision, and correcting a problem noted in the report of the
Division's 9/24/09 inspection. You will note that this technical revision is designated as TR-01.
The timeliness of the submittal acts to correct the outstanding problem, but the content of the submittal is not
adequate for approval as a weed control plan. There may have been some misunderstanding about what the
weed control plan must include, since J.Barry's letter only describes a commitment to perform a single
treatment. Even though the infestations noted on the site are probably young, there is a strong possibility
that numerous treatments of several years will be necessary to eliminate them. Due to the small size of these
patches, and lack of other infestations in the area, they should be treated until they are fully eliminated, not
just kept in check.
A weed control plan must include, at a minimum, the following:
1. a list of the weed species known to be present;
2. a description of each infestation, including location and estimated weed density; it may include a sketch
map and measurements;
3. a plan for monitoring the infestation, including the frequency and who will monitor it; and
4. a plan for treating the infestation, including a schedule and the method(s) of treatment. This item should
provide the name of the herbicide and the application rate, and/or other means to be employed (mowing or
hand-pulling, for example).
The plan should identify who assisted with developing the plan. The plan does not need to include the name
of the applicator or the cost of the treatment, as those things may change over time.
We suggest you call upon local weed control district staff or a professional applicator, who has expertise in
this subject, to assist with developing a weed control plan. It does not need to be overly complicated, but it
Office of Office of
Mined Land Reclamation Denver Grand Junction Durango Active and Inactive Mines
