T'he exploration program will otherwise comply with the requirements of Rule 2.02 of the <br />Regulations of the Colorado Mined Land Reclamation Board. <br />6.0 CULTURAL RESOURCES AND BIOLOGICAL CLEARANCES <br />Cultural and paleontological resources, threatened and endangered (T & E) species block <br />clearance assessments have been completed in 2005 for the roads and sites included in this NOI. <br />Copies of the reports have previously been forwarded to the Division and appropriate agency(s) <br />as soon as they were completed. The areas to be drilled are located in the mountain shrub <br />vegetative community and the block clearance report indicate no need to conduct nesting raptor <br />surveys due to the lack of nesting habitat. The block clearance report has determined that the <br />exploration and reclamation described will not jeopardize the continued existence of an <br />endangered or threatened species listed pursuant to Section 4 of the Endangered Species Act of <br />1973 (16 U.S.C. 1533) or the Nongame, Endangered or Threatened Species Conservation Act <br />(Section 33-8-101 et seQ C.R.S.) or result in the destruction or adverse modification of critical <br />habitat of those species. <br />9.0 RECLAMATION COST ESTIMATE <br />There is approximately 4,820' of new temporary road construction, 2.25 acres of pad disturbance <br />and 22,430' of total drill depth (4" casing).. OMLLC requests that the Division prepare the <br />reclamation cost estimate for the 9 drill pads and associated roads. <br />Page 6
