Dudash, Environmental Protection Specialist <br />Colorado Division of Reclamation, Mining, and Safety <br />1313 Sherman St., Room 215 <br />Denver, Colorado 80203 <br />RE: TR-66 Ventilation Shaft Construction - Bowie Resources, LLC (BRL) - Federal Coal Lease COC61209 <br />Dear Mr. Dudash: <br />In response to your letter of December 22, 2009 giving notice of an application to revise coal mining operations at <br />the Bowie No. 2 Mine, we are providing the following comments. <br />Right of Entry <br />Regarding access to the proposed ventilation shaft construction site where the proposal for that access is along an <br />existing road down Terror Creek approaching the site from the north, we should note that a right-of-way agreement <br />between the BLM and BRL will be required. The reasons for that requirement are as follows: <br />1. Approximately 1400' of the access road crosses surface in T.13S. R91W of the 6 h P.M., section 5: NWSE; <br />and W4NESE, that is managed by BLM; and, <br />2. The access is outside the boundary of the federal lease; therefore it is not covered under the lease <br />agreement. <br />Right of Construction <br />Regarding the proposed ventilation shaft construction, we are aware that a portion of the access to the site and the <br />collar of the shaft are located on BLM surface as well as on the existing federal coal lease COC61209. Under the <br />lease agreement BRL has a right to access and construct ventilation facilities that serve the underground mining <br />operation as long as they abide by all fifteen sections under the terms and conditions of the lease; especially those <br />sections intended to protect other resources during surface disturbing activities. We call your attention particularly <br />to three sections. In section 7 prevention of waste, damage, or degradation to biological resources covers protection <br />of threatened and endangered species. In section 15(a) requirements for an inventory of cultural resources is spelled <br />out along with steps to protect/mitigate those resources, and in section 15(b) steps to determine the need for a <br />paleontological appraisal are given and must be followed. <br />Federal coal lease agreement COC61209'is enclosed for your reference. <br />If you have any questions please call Desty Dyer at 970-240-5302. <br />Sincerely, <br />Barbara Sharrow, Manager <br />ENC: Federal Coal Lease COC61209
