III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> while a riprapped channel would be necessary for channel segments with gradient between I 1% <br /> and 16%. <br /> Observations during the SL-2 inspection were that the channel had been riprapped and appeared <br /> to be stable, with the exception of a short segment near the upper end, where it appears that a <br /> small slump or slope irregularity resulted in a short, steep drop in the channel (Photo SL2-52). In <br /> this location, the liner was exposed and riprap was washed out. <br /> Given the fact that the channel is stable along most of its length, does not diverge significantly <br /> from premine gradient, and is within or very close to the gradient range specified in the Postmine <br /> Channel Design Summary, the Division will not exclude Channel 006-SI from its proposed <br /> approval decision for SL-2. However,the segment of channel impacted by the sudden drop, <br /> or scarp, depicted in Photo SL2-52 will need to be properly regraded in 2010 to eliminate <br /> the abrupt slope change, and the repaired segment will need to be riprapped in accordance <br /> with approved design. <br /> Channel 006-SE1 <br /> This channel drains the southwest portion of the reclaimed"A"Pit area, and joins 006 Gulch <br /> near its lower end. Some maintenance concerns were identified by the Division in the 2006 <br /> channel inspection, but no problems were noted during the SL-2 inspection. The lower segment <br /> of the channel had recently been repaired and lined with TRM, and appeared to be in good <br /> condition. <br /> Eastern Ridgeline Areas <br /> The area of coal extraction within the original permit area was a dip-slope land form, in which <br /> the land surface was a broad expanse of long, relatively gradual slopes that rise from west to east, <br /> broken up by a number of ephemeral drainages that flow to the west into Dry Creek or its <br /> tributary Hubberson Gulch. The eastern boundary of the mining area was defined by a <br /> north/south trending ridgeline that drops abruptly off to the east, into steep sided tributaries of <br /> Sage Creek. The ridgeline area was inspected by driving slowly along the Ridgeline Access <br /> Road and Ridgeline Light Use Road segments (LU-3 and LU-4),with periodic stops to allow for <br /> short walks for closer observations. The ridgeline area within the original permit area has been <br /> graded to blend into the adjacent undisturbed slopes, vegetation in most areas is well established, <br /> and there were no locations where excessive erosion or instability was evident. <br /> 17 <br />
