November 25, 2008. The inspection was conducted in accordance with Section <br />3.03.2(2). The Division's bond release inspection report is on file at its Denver <br />office and is incorporated by reference in this written finding. Kent Gorham <br />represented the Division. The inspection focused on a final evaluation of all <br />reclaimed areas, including erosion and slope stability of the reclaimed lands, and <br />implementation of the post mining land use. As explained in the Division's <br />inspection report, hereby incorporated by reference, field observations support a <br />finding to approve a termination of jurisdiction and liability release. <br />Completion of Evaluation Required by Section 3.03.2(2) <br />The Division has conducted an evaluation of the reclamation work, in accordance <br />with Section 3.03.2(2). This evaluation considered, among other things: the results <br />of inspections and monitoring, the need for further reclamation work, whether <br />pollution of surface or subsurface water is occurring, and the probability of future <br />occurrence of such pollution. The evaluation concluded that all reclamation has been <br />completed in the bond release area, no water pollution is occurring, and there is little <br />potential for future water pollution. Impacts to ground water and surface water are <br />described below. <br />Ground Water Impacts <br />Twin Pines Investment Limited predicted four possible consequences to ground water <br />due to mining at the Twin Pines No. 2 Mine. Each potential consequence will be <br />addressed separately below along with a brief analysis of the accuracy of the possible <br />consequence and any resulting impact. <br />• Changes to the Oak Creek alluvium <br />• Impacts to the Caldirola No. 2 well <br />• Changes to ground water balance in aquifer below the Brookside seam <br />• Alteration of aquifers above the coal seam due to mining and subsidence <br />The City of Rockvale has 5 alluvial wells on Oak Creek upstream of the <br />confluence of Lewis Gulch and Oak Creek. The City also has one additional <br />alluvial well downstream of the confluence and a private well also exists <br />downstream of the confluence. The Twin Pines No. 2 portal area is located <br />along Lewis Gulch and mine water discharge and surface runoff could affect <br />the alluvial wells downstream on Oak Creek. No shallow alluvial monitoring <br />wells were included as part of the Twin Pines approved hydrologic <br />monitoring plan, likely because the chance that these wells would be <br />impacted from the discharge of degraded water from the mine was <br />determined to be insignificant. No direct disturbance to any of the existing <br />alluvial wells was proposed or approved. During operations and over the <br />reclamation liability period, there have been no complaints from the owners <br />of these wells regarding impacts potentially caused by the mining and <br />13
