Cattany <br /> <br />Oak Creek, CO 80467 Division Director <br />Natural Resource Trustee <br />Re: Foidel Creek Mine, Permit No. C1982-056, TR70, Adequacy No. 2 <br />Dear Mr. Nettleton: <br />The Division received Twentymile Coal Company's (TCC's) application for a technical revision (TR70) <br />on November 20, 2009. The Division has reviewed the proposed revision and sent an initial adequacy <br />letter to TCC on December 30, 2009. Twentymile Coal Company provided adequacy responses on <br />January 4, 2010. After review of TCC's responses, the Division has the remaining concerns: (Numbering <br />continues from the initial adequacy items.) <br />4. Twentymile Coal Company indicated in the Adequacy Response letter, dated January 1, 2010, <br />that TCC has notified Routt County Road and Bridge Department and is waiting for a follow up <br />site inspection with a representative from Routt County. The Division spoke with Paul Draper of <br />Routt County Road and Bridge Department on January 6, 2010. Mr. Draper indicated that <br />Tammy Crawford would be the County contact for this project. Ms. Crawford contacted me on <br />January 11, 2010. Ms. Crawford informed me that TCC will need to obtain a "Utility Install <br />Right-Of-Way" permit before proceeding with the work within the county road right-of-way. She <br />indicated that TCC will need to provide a site plan and utility locates to her office. Snow pack <br />and winter weather may slow this permitting process. Please provide evidence to the Division <br />that TCC has obtained a "Utility Install Right-Of-Way" permit from Routt County Road and <br />Bridge Department prior to conducting work within the county road right-of-way. <br />7. Revised pages 4.05-45.19, and 2.05-50.7 indicate that sediment control materials will be used at <br />any location where the pipeline corridor is within 50 feet of Fish Creek. The reader is directed to <br />Design drawings in Exhibit 49R for construction and sediment control details. TCC submitted <br />Figure 1 "Route for 14" HDPE Pipeline from 18L Shaft to existing 12" HDPE line from the Fish <br />Creek Vent Shaft" (dated 9/18/2009). This Figure shows a general layout of the proposed path <br />for the 18L waterline. This figure does not show topography, location or designs of sediment <br />control measures. Previously approved figures in Exhibit 49R depict pond designs and shaft <br />dimensions for the 18L ventilation shaft and pad. The Division was unable to locate any designs <br />or drawings of the proposed placement of the sediment control measures proposed for the 18L <br />waterline construction.
