United States Department of the Interior ?M oFr <br /> <br />OFFICE OF SURFACE MINING <br />ell <br />Reclamation and Enforcement <br />? <br />Western Region Office SURFA? <br />1999 Broadway, Suite 3320 <br />Denver, CO 80202-3050 <br />Loretta Pineda, Acting Director 2 4 GcC 2W9 a • „?F <br />'h' <br />Division of Reclamation, Mining and Safety <br />1313 Sherman Street, Room 215 <br />Denver, CO 80202 <br />RE: Partial Phase I, II, and III Bond Release (SL-10), Edna Strip Mine, Permit No. <br />C-1980-001, DRMS Proposed Decision and Findings of Compliance, December 14, 2009 <br />Dear Ms. Pineda, <br />This letter acknowledges the Office of Surface Mining (OSM), Denver Field Division's (DFD;) <br />receipt and review of the above Phase I, II, and III Bond Release Proposed Decision document <br />prepared by the Division of Reclamation, Mining and Safety (DRMS) dated December 14, 2009. <br />DFD agrees with the findings and decision document and hereby provides OSM concurrence for <br />the above bond release action in accordance with 30 CFR 740.15 (d) (3), and 30 CFR 906.30, <br />Article IX, Section 24, of the State-Federal Cooperative Agreement. <br />DRMS's Proposed Decision documents the applicant's compliance with the Colorado approved <br />regulatory program at Rule 3.03.2, and DRMS's bond release guidelines dated April, 18, 1995. <br />This Phase I, II, and III bond release requests applies to 13.3 acres consisting of a portion of the <br />lower facilities gravel pad, entrance and access road/gate, and the permanent sediment drainage <br />basin at the north end of the Oak Creek Facilities Area. <br />OSM finds that Chevron Mining Inc. has met or exceeded the requirements for Phase I, II, and <br />III bond release on the 13.3 acres of land as described above. DRMS currently holds a <br />performance bond in the amount of $3,071,961. This action will release $300,664.00. DRMS has <br />determined that the remaining bond amount of $2,771,297 is sufficient to complete all remaining <br />reclamation obligations at this site if the work had to be completed by a third party contractor. <br />OSM concurs with the proposed bond release amount. <br />Thank you and your staff for coordinating this Federal mine bond release action through the <br />DFD.
