Neuhart@state.co.us' <br />Subject: Foidel Creek Mine proposal to temporarily dam Fish Creek <br />Good Morning Andrew, <br />The Division of Reclamation, Mining and Safety has received an application from the Twentymile Coal Company to <br />construct a waterline at the Foidel Creek Mine in Routt County. The activity is proposed to occur in T5N, R87W in the S <br />%2 Section 23 and SW X Section 24. The Division sent the WQCD-Permit Section a letter regarding this revision <br />application on November 30, 2009. That letter notified your agency that Twentymile Coal Company was proposing to <br />install a waterline, but it did not note that the company proposes to temporarily dam Fish Creek (a perennial stream) <br />and pump the flow from Fish Creek around the work area as the company trenches the waterline across Fish Creek. <br />My question to you, is there any special approvals that Twentymile Coal Company (TCC) needs to obtain from WQCD <br />prior to conducting this work? And if there is, could you let me know what the process is and what action the company <br />needs to do? Thanks.
