Permanent revegetation as described in the mining and reclamation plan has occurred <br />at the Carbon Junction Mine at all disturbed areas of the mine slated for revegetation. <br />Additional Information <br />The following CDRMS permitting actions or revisions were undertaken in 2009. <br />Phase III Bond Release Application (SL-04) <br />On July 30, 2008 an application for Phase III bond release was submitted to CDRMS. <br />This application seeks release for successful final reclamation at the North Pit, North Pit <br />Haul Road, Topsoil Stockpile #2, the Previously Reclaimed Spoils Area, South Pit Drill <br />Pad, Equipment Yard, Topsoil Stockpile #7, and ancillary areas at the mine under CRS <br />34-33-125(9)(c) and Rule 3.03.1(2)(c). The Division initially found the application <br />incomplete on September 26, 2008, and with the submittal of a certification statement, <br />found the application complete on October 10, 2008. CDRMS conducted the on-site bond <br />release inspection on October 29, 2008. The Division has expressed concerns that an <br />adequate demonstration that the post-mining land use of residential use has not been <br />implemented, while Oakridge Energy, Savage and Savage, and Goff Engineering and. <br />Surveying contend that by platting and recording 35 acre parcels with the State of <br />Colorado and La Plata County the post-mining land use has been implemented. A final <br />decision by CDRMS is pending. <br />Disturbed Acreage <br />By the end of calendar year 2009, a total of 41.93 acres of disturbance during the life of <br />the mine was reclaimed to final configuration. Previously, 14.31 acres of mine <br />disturbance was released (SL-02, Phase I/II/III). The remaining disturbed acreage (3.38 <br />acres) includes a portion of topsoil pile 4. <br />The CDRMS annual reclamation report form is appended.
