///. COMMENTS -COMPLIANCE
Below are comments on the inspection. The comments include discussion of observations made during
the inspection. Comments also describe any enforcement actions taken during the inspection and the
facts or evidence supporting the enforcement action.
This was a partial inspection conducted by Tom Kaldenbach of DRMS. Ryan Sweetwood of
Mountain Coal Company represented the operator.
With the operator's consent, this report was issued from the Denver office of DRMS.
The longwall was active more than half-way through E-Seam Panel 1. The ground in most areas was
covered with more than one foot of snow, which limited inspection.
Hydrolnic Balance
No discharge was occurring at the mine water discharge site in Sylvester Gulch (CDPS outfall 017).
Construction of the recently approved pond MB-5E has not begun.
Processing Waste
Much of the equipment has been removed from the top of the LRP in preparation for the recently
approved construction of a coal processing plant at this location. There was no activity on the RPE.
Support Facilities
No problems were found in facility areas in Sylvester Gulch, the materials storage bench, or at the rail
loadout.
General Mine Plan Compliance
The operator appeared to be following the approved mine plan.
Documents Received
None.
3
