€,1 OFFICE of ARCHAEOLOGY and HISTORIC PRESERVATION
C9d -a ti
December 24, 2009 RECEIVED
Travis H. Marshall Q 2 1
Environmental Protection Specialist JAN
Division of Reclamation, Mining and Safety Division of Reclamation,
Department of Natural Resources Mining and Safety
1313 Sherman Street, Rm. 215
Denver, CO 80203 /
Re: Moores Mining, LLC, Moores Pit (Permit No. M- 1980 - 178) ✓ (CHS #56236)
Dear Mr. Marshall:
Thank you for your correspondence dated December 22, 2009 (received by our office on December
23, 2009) regarding the subject project.
A search of the Colorado Cultural Resource Inventory database indicates that several cultural resource
inventories have been conducted near the proposed project area and at least two historic properties are
located nearby. Site 5ME11269 recorded in 1997 by Grand River Institute. It was recommended
that'additional data were needed in order to assess its eligibility for the National Register of Historic
Places (NRHP). Site 5ME13044, State Highway 141 was recorded in 2002 by Associated Cultural
Resource Experts. It was recommended as eligible for the NRHP. We recommend that the operator
avoid these sites or that additional inventory be conducted to determine the effect of the proposed
project on these resources. If site avoidance is not possible, we recommend further consultation with
our office in order to identify options to avoid, minimiz or mitigate the adverse effect to the sites.
Should human remains be discovered during mining activities the requirements under State law CRS
24 - 80 part 13 apply and must be followed.
Thank you for the opportunity to comment. If we may be of further assistance, please contact Shina
duVall, Section 106 Compliance Manager, at (303) 866 -4674 or shina.duvall(2chs. state. cO.us
Sincerely,
'. 4 .
Edward C.
