section, if the surface area proposed to be affected by the operation contains prime farmland, the <br />office shall, after consultation with the secretary of the United States Department of agriculture, <br />and pursuant to regulations issued by the secretary of the United States department of the interior <br />with concurrence of the secretary of the United States department of agriculture, grant a permit to <br />mine on prime farmland if the board or office finds in writing that the operator has the <br />technological capability to restore such mined area, within a REASONABLE time, to <br />EQUIVALENT OR HIGHER LEVELS OF YIELD as non -mined prime farmland in the <br />surrounding area under equivalent levels of management and the operator can meet the <br />reconstruction standards of soils." I will contact them and see if they were informed and tell them <br />that NOW THE OPERATOR WANTS TO PUT OUR PRIME FARMLAND BACK INTO <br />DRYLAND AND SEE WHAT THEY THINK!!!! Remember it has already been 10 years! And <br />your laws say that reasonable time so that prime soils do not deteriorate. <br />I cannot believe that DRMS would allow the OPERATOR to determine if there is enough <br />irrigation available when they are suppose to return it to conditions as good as or BETTER <br />THAN WHEN THEY ENTERED to a HIGHER standard and that doesn't mean to take irrigated <br />lands and restore them to dryland. <br />I will continue reading and studying all of these laws.
