Surface owner: Cross Mountain Limited Partnership (CMLP) <br />Multiple contacts have been made with this surface owner for the proposed use of the <br />surface land. Twentymile has proposed entering into a Surface Use Agreement and <br />Subsidence Deed with the surface owner. Twentymile Coal has the rights necessary to <br />conduct all planned activities on the surface property by virtue of its coal leases. It is <br />Twentymile's intent to reach a mutually beneficial agreement with CMLP and proceed in a <br />manner provided for in its proposed Surface Use Agreement with the surface owner. <br />Additional information will be provided as it becomes available from the surface owner. <br />3. Describe type of project: <br />Construction of 18 Left Intake and Return Shafts: <br />As mine development proceeds to the west in the Western Mining District (WMD), the <br />distance from existing mine ventilation shaft and fan installations will increase to the point <br />where additional intake and exhaust ventilation shafts are necessary to maintain effective <br />ventilation of active mining areas. In order to minimize surface disturbance and simplify <br />
