5. In the event that Routt County commences an action to enforce or interpret this <br />SUP, the substantially prevailing party shall be entitled to recover its costs in such <br />action including, without limitation, attorney fees. <br />6. No junk, trash, or inoperative vehicles shall be stored on the property. <br />7. This permit is contingent upon any required permits being obtained and complied <br />with for air and water emissions, reclamation, and other appropriate permits from <br />all involved agencies. Including, but not limited to CDMG Mined Land Reclamation <br />permit and Colorado Department of Health Air Pollution Emission Notices. The <br />operation shall comply with all federal, State, and local laws. <br />8. Fuel, flammable materials, or hazardous materials shall be kept in a safe area and <br />shall be stored in accordance with state and local environmental requirements. <br />9. All exterior lighting shall be downcast and opaquely shielded. Motion sensitive <br />lighting shall be employed where appropriate. <br />10. Prior to the issuance of the permit, the permittee shall provide evidence of liability <br />insurance in the amount of no less than $1,000,000 per occurrence with either <br />unlimited aggregate or a policy endorsement requiring notice to Routt County of all <br />claims made. Routt County shall be named as an additional insured on the policy. <br />11. The permittee shall prevent the spread of weeds to surrounding lands and comply <br />with the Colorado Noxious Weed Act and the Routt County Noxious Weed <br />Management Plan. <br />12. Routt County has the authority to close any county road at its discretion if such <br />road surface is in poor condition and would be further damaged by additional use. <br />1,3.A grading and excavating permit and storm water management plan will be <br />required by the Routt County Road and Bridge Department if more than 300 cubic <br />yards of soil is displaced for the construction of the ventilation shaft pad site. <br />14.Any new signage associated with the Special Use Permit (SUP) shall meet the <br />applicable requirements of Section 5.9 of the Routt County Zoning Regulations. <br />Specific Conditions <br />15. Routt County roads shall not be completely blocked at any time. Traffic shall be <br />directed by use of adequate signage and flagmen if necessary, according to <br />standards of the Manual on Uniform Traffic Control Devices (MUTCD). If deemed <br />necessary, the Routt County Road and Bridge (R &B) Director shall determine if the <br />following conditions will be activated: <br />a. The permittee or contractor shall place adequate signage on County Road <br />27 during construction, alerting other drivers on the county road system of <br />trucks turning off of and onto County Road 27. <br />b. A fence shall be erected around the perimeter of the site to fence livestock <br />out. A cattle guard and gate are also recommended to prevent livestock from <br />entering County Road 27. <br />c. All County roads used for the project will be maintained by the contractor <br />and /or permitted to accommodate the additional truck traffic during <br />construction, as required by the Routt County Director. <br />d. An access permit shall be obtained from the Routt County Department. <br />16. The permitee shall apply for and receive a Mined Land Reclamation Bond permit <br />and post a reclamation bond with the MLRB prior to commencing any operations. <br />The permitee shall be responsible for reclamation as set forth by the Colorado <br />Mined Land Reclamation guidelines. The permittee will provide Routt County <br />Planning Department with a copy of the State of Colorado, Division of <br />Reclamation, Mining, and Safety (CDRMS) bond prior to issuance of the Special <br />Use Permit. <br />
