C-1981-022, TR-65 <br />Preliminary Adequacy Review <br />29 December 2009 <br />Page 2 of 3 <br />Cultural Resources Assessment <br />A "Class III Cultural Resources Inventory of the Block Clearance Area Project" was <br />prepared in August 2005 by the Grand River Institute. This document was incorporated <br />into Exhibit 2.04.7 of the permit with MR-79 in June 2006. Areas to be affected by TR- <br />65 were inchided in the inventory. <br />In response to the Division's notification to other agencies of this application for a <br />technical revision to the Elk Creek Mine permit, a letter was received from the State <br />Historic Preservation Officer (dated 8 December 2009). The SHPO concurs that a <br />finding of no historic properties affected is appropriate. A copy of this response letter <br />is enclosed for your reference. <br />Reclamation Cost Estimate <br />The Division will prepare a reclamation cost estimate for the additional disturbance <br />proposed with TR-65. <br />Adequacy Items <br />The application package for TR-65 included revised page 2.05-50a (Table 2.05.4-T1); <br />revised Exhibit 2.04-E3, Item 9 - Methane Drainage Well Information; and revised Map <br />2.05-M1, Sheet 6 of 6. The Division has reviewed these items for adequacy, and our <br />comments are itemized below. <br />1. Exhibit 2.04-E3 Item 9 has been updated (for TR-64) to reflect borehole drilling <br />activities completed in 2009. Please update the TR-65 Exhibit 2.04-E3 Item 9 <br />with data for the sites drilled in 2009. <br />2. The column headings for Item 9 appear only on the first page. Please revise the <br />table to include the column headings on each subsequent page. <br />The USFS Paonia Ranger District submitted comments pertaining to TR-65 in a <br />letter dated 19 November 2009 (copy attached). OMLLC has responded to the <br />USFS comments in a letter (copy received by the Division on 22 December). If <br />any changes to the permit are necessary as a result of responses to comments <br />made by the USFS, please revise the permit application accordingly and submit <br />the revisions to the Division. <br />4. As you are aware, the proposed activities lie within an inventoried roadless area. <br />The Division will be unable to issue a decision to approve TR-65 until these <br />issues are resolved to the satisfaction of the USFS.
