The West Elk Mine is located on stream segments 2 and 6 of the
North Fork of the Gunnison River. Instream Numeric Standards
for segments 2 and 6 are set forth in Rule 35 of CWQCD
regulation 5 CCR 1002. Calculated Table Value Standards for
instream metal concentrations are shown in Tables A-4 and A-5
of West Elk's discharge permit (CDPS permit CO-0038776).
West Elk discharges surface runoff and/or mine water to
segments 2 and 6 via CDPS outfalls. CWQCD based effluent
limitations at these outfalls on values that would not cause
exceedances of instream standards. West Elk's compliance with
G. Instream CWQCC its effluent limitations in 2004 indicates the instream standards
