[~ <br />2.03.7 Relationship to Areas Designated Unsuitable for Mining <br />The permit areas are not within an area designated unsuitable for surface <br />mining activities as defined in Rule 7 or 30 CFR 764 and 765, or under <br />study for designation in an administrative proceeding under Rule 7 or 30 <br />CFR 764 and 765. <br />Because the permit area is located within 300 feet of several occupied <br />dwellings in Somerset, Colorado, the applicant has obtained a waiver from <br />the individuals who own or occupy these dwellings. These waivers are set <br />forth in Exhibit 2, Waivers from Owners or Occupants of Dwellings Within <br />300 Feet of Permit Area. <br />2.03.8 Permit Term Information <br />The Bear No. 3 Mine operated from 1982 until November 9, 1996 when <br />mining ceased. The mine portals were sealed on January 9, 1997. The <br />Bear Nos. 1 & 2 Mines have been idle since 1981. The Mine Plan Map for <br />the B-Seam, Map 9A, shows the mining which was performed in the No. 3 <br />Mine. <br /> <br />The Bear Mines have affected approximately 704 acres to date in <br />Sections 8, 16, 17, 18, 20 and 21. <br />The current approved mining permit will expire July 2012.
