Garcia, Box 8749, Denver CO 80201 -8749, requests a Surface <br />Water Right by Amended Application filed February 6, 1997. <br />FINDINGS OF FACT <br />1. All notices required by law of the filing of this <br />Application have been given. The Referee has jurisdiction of <br />this case. The time for filing of statements of opposition has <br />expired and no such statements have been filed. <br />• 2. Applicant requests an absolute water right for the <br />PAVKA SPRING NO. 1, which is located 2200 feet west of the east <br />section line and 2100 feet north of the south section line, <br />Section 29, Township 13 South, Range 91 West, 6th P.M. This <br />diversion takes water tributary to the North Fork of the Gunnison <br />River. Applicant desires to have absolute flow rights for .25 <br />c.f.s. for fire protection, industrial•, and irrigation uses. The <br />Court finds that the PAVKA SPRING NO. 1 will produce .25 c.f.s., <br />and that Applicant has placed this water to the beneficial uses <br />requested. <br />RULING <br />Applicant is hereby GRANTED an absolute water right for <br />.25 c.f.s. of water for fire protection, industrial, and <br />irrigation, from the PAVKA SPRING NO. 1, located as <br />above - described, with an appropriation date of July 31, 1977 as <br />to the fire protection and industrial uses and of May 31, 1995, <br />as to irrigation, with adjudication date of 1996. <br />Dated this Ok_-day of , 1997. <br />[M att- <br />No protest was filed in this imtter.
