0 COMPLIANCE INFORMATION <br />Pursuant to Rule 2.03.5(3) of the Regulations of the Colorado Mined Land <br />Reclamation Board for Coal Mining, the attached is a listing of each <br />violation notice received by Hayden Gulch Terminal, Inc. (HGTI), Permit No. <br />C-92-081, for the period May 23, 2006 to May 5, 2009 for any violation of a <br />provision of the Act, or of any law, rule, or regulation of the United <br />States, or of any State law, rule, or regulation enacted pursuant to Federal <br />law, rule, or regulation pertaining to air or water environmental protection <br />incurred in connection with any surface coal mining operation. A list of all <br />unabated cessation orders and unabated air and water quality violation <br />notices received between May 23, 2006 and May 5, 2009 by any surface coal <br />mining and reclamation operation owned or controlled by either HGTI or by any <br />other operation in the HGTI - Peabody Energy Corporation family tree is also <br />included. <br />For each violation notice or cessation order reported, the list includes the <br />following information: <br />1. Company name, mine name, any identifying numbers for the operation, <br />including the Federal or State permit number and MSHA number and <br />location by State; <br />2. The date of issuance of the violation notice and the name of the issuing <br />regulatory authority, department or agency; <br />3. A brief description of the particular violation alleged in the notice; <br />4. The date, location and type of any administrative or judicial proceeding <br />initiated concerning the violation, including, but not limited to, <br />proceedings initiated by the applicant to obtain administrative or <br />judicial review of the violations; <br />5. The current status of the proceedings and of the violation notice; and, <br />6. The final resolution of any notice of violation. <br />It should be noted that the attached represents a complete listing of the <br />above-described violation notice or cessation orders and their status as <br />reflected by the file of the Office of the General Counsel of Peabody <br />Investments Corportion, 701 N.
