EASEMENT AGREEMENT <br />THIS EASEMENT AGREEMENT is dated this (F" day of f , , <br />2001 between West Routt Rural Heahh Council, Inc. (herein "WRRHC") and Hayden <br />Gulch Terminal, Inc. (hereht "HGT"). <br />WHEREAS, WRRHC is the ovmcr of property described as Lot 1, Hayden Gulch <br />Terminal Subdivisioq Routt Coumy, Colorado {herein "Lot 1 ") and Lot 2B, Hayden Gulch <br />Terminal Subdivisioq Filing No. 3 (herein "Lot 2B"), and <br />WHEREAS, HGT are the owners of property described as Lot 2A, Flayden Gulch <br />Terminal Subdivision Filing No. 3, Routt County, Colorado (herein "Lot 2A"), and <br />WHEREAS, HGT owns a water well (herein "the water well") on Lot 2B as a resuh <br />of the replat of Lots 2A and 2B and WRRHC wishes to grant HGT a right to access such <br />water well for all purposes irrcludirrg, but not limited to, use and manrtenance of such weA <br />NOW, THEREFGRE, the parties agree as follows: <br />WRRHC, hs successors and assigns, hereby grants to HGT, its successors and <br />assigns a perpetual easement to the water well for all pu~posesntcluding, but not limited to, <br />use atxl maintenance of such water we1L HGT shall have a right to enter upon that portion <br />of Lot 2B h'mB rtorih of Lot 1 to access the water weU as is most conveniem for HGT at <br />arty time. WRRHC recognizes HGT's right to aocess, use and maintain the wattt well, but <br />HGT shall do so in a manner that does not utumcessarity interfere with the use and quiet <br />enjoyment of the residetrts and sta$of The Haveq the senior assisted living facility <br />currently bcated on Lot 1.
