than the total amount proposed to be disturbed by the Carbon Junction operation at buildout. <br />The sand and gravel operations are conducted within the proposed disturbed area of the coal <br />mine and minimize impacts to the surface water regime through the use of the same sediment <br />control technology as the coal mine. Groundwater impacts from the sand and gravel operation <br />are not anticipated as the operation is mining dry alluvial terrace gravels. Therefore, the <br />predictions of the PHC remain valid. <br />There are no users of surface waters or persons who have water rights in, or adjacent to, the <br />permit area other than the present landowner. The potential impact to the nearest ground water <br />wells has already been addressed in Section 2.04. OEI will pursue obtaining the necessary <br />priority numbers for the water it develops during the course of mining activities. Adjudication <br />can occur after beneficial use actually occurs. <br />The quantity of water, both surface and underground, will be protected from adverse effects of <br />the mining operation. All surface water originating in and above the drainage area will be <br />allowed to flow to the Animas River as it always has. The Animas River is not over <br />appropriated. <br />Water Monitoring <br />After discussions with CDRMS, it was determined that spring/seep and groundwater monitoring <br />at the Carbon Junction Mine is no longer necessary. The monitoring program was terminated as <br />of the first calendar quarter of 2006. <br />Oakridge conducted a spoils monitoring program as a part of the protection of the hydrologic <br />balance in the reclamation program. The spoils monitoring began with spring runoff in 1998, <br />and determined that no significant discharge occurred. A single monitoring point was established <br />at the base of the spoil at the lower end of the underdrain. <br />2.05.6(4) Protection of Public Parks and Historic Places <br />There are no public parks or historic places near the mine site. <br />2.05.6(5) Surface Mining Near Underground Mining <br />There are no underground mining activities near this surface mine. <br />2.05.6(6) Subsidence Survey, Monitoring, and Control Plan <br />The requirements of this section do not apply, Carbon Junction is a surface mine. <br />Abridged Permit Document 5 -37 Feb 2008 <br />
