interest in the land use of this property. Adjacent BLM surface lands have been classified as <br />ungulate winter range with recognition of mineral development and extraction land uses. <br />Post - Mining Land Use Feasibility <br />Where necessary, the rules require a feasibility demonstration of the post - mining land use related <br />to projected land use trends and markets. This demonstration and accompanying plans are not <br />necessary, as the landowner is the developer and operator of the commercial ventures taking <br />place on the property. As such there will be no outside interests who will dictate land use trends <br />and/or markets. Landowners are entitled to conduct operations and businesses on their own <br />property which are consistent with the approved general land uses. Successful reclamation will <br />be accomplished on disturbed areas within the permit area boundary which would not be of use <br />in the development, construction, or operation of the planned and approved land uses. <br />Designation of an alternative land use would in no way hinder reclamation. Where <br />modifications to the approved reclamation plan are required to best serve the approved post - <br />mining land uses, Oakridge Energy will secure these prior to initiation. <br />Public Health and Safety <br />The proposed uses would not present actual or probable hazard to public health or safety, nor <br />actual or probable threat of water flow diminution or pollution. Residential and recreational <br />development is regulated by the La Plata County Planning Department. Public health and safety <br />issues are therefore addressed within the context of their review and approval of projects. Public <br />health and safety issues for the operation of the industrial and commercial ventures will be <br />regulated by MSHA (mining) and OSHA (other commercial ventures). For the existing land <br />uses as described above, the required development, operation, and reclamation permits have been <br />or will be secured. <br />Reclamation Delays <br />As these land uses have already been implemented, there would be no delay in reclamation of the <br />mine site attributable to implementation of the post - mining land uses. <br />Fish and Wildlife Values <br />This rule pertains to alternative land use changes proposed during a permit application process <br />and prior to surface coal mining operations. In any event, there are no adverse impacts to fish, <br />wildlife or related environmental values by approving the proposed land use changes. <br />Land Use Changes to Cropland <br />This rule does not apply, as the alternative post - mining land use being requested is not cropland. <br />• <br />Abridged Permit Document 5 -32 Feb 2008 <br />
