Mr. Andy Rodriguez, P.E. <br />December 22, 2009 <br />Page 3 <br />The well is currently permitted for industrial, commercial and augmentation use. The <br />Applicant's accounting includes the 2% relinquishment requirement for the nontributary <br />Laramie -Fox Hills water. <br />In addition to replacing depletions resulting from this mining operation, the Laramie -Fox <br />Hills aquifer water, will also be used by the Applicant to replace 10.86 acre -feet of depletions <br />resulting from operations at the Parker- Dersham Resource site in accordance with the C.R.S. <br />37 -92- 308(11) SWSP approved for Hall- Irwin. Since the Laramie -Fox Hills water is being used <br />as a replacement ,,source for both plans, the applicant's accounting for each SWSP must <br />specify the total amount of Laramie -Fox Hills water released and the amount associated with <br />each SWSP. <br />A monthly breakdown of depletions and replacements is shown in attached Table 3. <br />Conditions of Approval <br />I approve the proposed substitute water supply plan in accordance with Section 37 -90- <br />137(11), C.R.S., subject to the following conditions: <br />This SWSP shall be valid for the period of January 1, 2010 through December 31, 2010, <br />unless otherwise revoked, modified, or superceded by decree. If this plan will not be <br />made absolute by a water court action by the plan's expiration date, a renewal request <br />must be submitted to this office with the statutory fee (currently $257) by November 15, <br />2010. <br />2. Well permit no. 66959 -F (WDID 0203017) was obtained for the current use and exposed <br />pond surface area of the gravel pit pond in accordance with §37 -90- 137(2) and (11), <br />C.R.S. <br />3. The total surface area of the groundwater exposed at the Baseline Pit must not exceed 7.6 <br />acres (0.46 acres in the dewatering trenches and 7.18 in the settling ponds) during the <br />approval period of this SWSP resulting in an annual evaporative loss of 22.38 acre -feet. <br />4. The annual amount of water used for dust control shall not exceed 1.66 acre -feet and the <br />annual amount used for concrete batching of 92,000 yards of concrete shall not exceed <br />11.29 acre -feet. <br />5. Total consumption at the Baseline Pit must not exceed the aforementioned amounts <br />unless an amendment is made to this plan. <br />6. Approval of this plan is for the purposes as stated herein. Any additional uses of this <br />water must first be approved by this office. <br />7. The applicant shall maintain daily records of all diversions, replacements, and the <br />amount of water used for each particular purpose. The applicant shall provide a report of <br />these records to the division engineer and the water commissioners on a monthly basis <br />
