?tt; Sandy Brown
)ivision of Reclamation, Mining, and Safety
313 Sherman Street, Room 215
)enver, Co. 80203
: Permit-Revision' U-,
ar Sandy, Marcia, and Dan

DEC 1 12009
,,,,,_ ,,eciarnation,
Mining and Safety
1, I. ?', C) V),)-
acts: Let's look at the map that the revision has enclosed and the referral areas that were also
nclosed. Although, the revision is suppose to be directed at west of 27 road, most statements
ave included numerous statements from east of 27 road.
1 Labeled dryland pasture. This from day one was continuously irrigated and during drought
iods, handsets and big guns irrigated the entire area. Where did this water come from?
so, this area produced 2 good cuttings of hay. 100 pounds per acre of fertilizer was being
died, also.
t: 157 acres of land was being irrigated with 73 shares of water. But take note of this, WFC
DE me shut the headgate down to half and even sometimes more. The headgate controlled
water which ran down a dtich across the dairy to a pond on WFC where I irrigated from. This
.d had a pipe going across to where my diesel pump was on the other side of the road. This
had a stem above ground and this stem from the base to where it topped out was
roximately 6-8 feet. When the pond was at its capacity then water would run over the top of
overflow stem. I would always be in trouble if for any reason the water would run over the
rflow, so the headgate would be shut more than half and even Ross and other mine
ervisors would shut the headgate down if the water was spilling over. The point here is that
enough water to irrigate the entire place with only half the water. This is all documented and
be proved. Except for when I was told to shut the water off for dust control and during very
ous drought years, the headgate was shut to at least half and I could irrigate 150 acrea off the
;el pump by itself.
diesel pump and the electric pump were on two separate systems and irrigated completely
-.rent areas This is also a critical fact to prove this map does not reflect accurately what really
place. WFC may show you what shares they had, but you do not have a copy of the
cement of some of those shares to irrigate other areas. This is also documented material that
prove the information to be inaccurate.
C says the Calamity draw to be equal to 100 shares. This statement is not accurate because
electric pump was NEVER NEVER allowed to pump over 1000 gallons per minute. The
;tric pump had burned up several times in the past and to eliminate that problem, we were
y allowed to run two siderolls and the flow meter was never allowed to read more than 1000
ons per minute. To get the 100 shares that is referred to, the pump would have to pump 1350
ons per minute. This is also all documented and can be proven. Also, the calamity draw at
beginning when water was first turned in, would not support any type of irrigation on WFC
