2 <br />provisions, similar to the ones discussed in this letter, will be provided in the agreement to ensure <br />the mining activities or drilling do not conflict with Western's transmission line or access to its <br />structures. <br />Bowie will need to coordinate with our operations center located in Western's Rocky Mountain <br />Region (RMR) Office in Loveland, Colorado. Clearances and/or hot line orders should be <br />considered. Bowie should contact Mr. Bill Marsh, RMR Safety Manager, telephone (970) 461- <br />7449, at least two weeks prior to commencement of any work beneath or adjacent to the <br />transmission line. Mr. Marsh will also arrange a required safety briefing with Bowie prior to any <br />work near the right-of-way to ensure that all workers and operators are aware of the dangers <br />associated with mining or drilling activities near high voltage transmission lines. <br />Western requires continuous, uninterrupted access to its facilities. This means that the roads <br />used to get personnel and equipment to Western's facilities cannot be restricted or impaired such <br />that access is denied. If a road is blocked or damaged, an alternate route must be provided. Any <br />damage to the road resulting from activities associated with the drilling or mining activities must <br />be repaired by Bowie Resources or its contractor. Finally, if Bowie improves the road itself, <br />Western has no obligation to maintain the road to the same standard as those improvements. <br />Western may require Bowie Resources to enter into a contractual agreement with Western to <br />ensure protection of the electrical facilities. More information about that can be provided after <br />the final location of the drill hole is determined. <br />Western appreciates the opportunity to provide comments on Bowie Resources, LLC proposed <br />Technical Revision Application No. 65.
