III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was an aerial inspection flown by Harry Ranney of the Colorado Division of <br />Reclamation, Mining, and Safety (Division). Kent Gorham reviewed oblique aerial <br />photographs in the office on December 23, 2009. This mine site is currently completing the <br />final stages of reclamation of disturbed areas. Ground conditions appeared partially snow- <br />covered and the weather appeared somewhat overcast as evidenced by limited ground <br />shadows. <br />Roads <br />The road that crosses the disturb area appeared passable with no apparent sign of damage <br />or heavy use. This road connects pre-existing roads to various coal bed methane wells <br />adjacent to the reclaimed area. <br />Hydrologic Balance <br />Generally, ponds held very little water (ice) or were dry. An exception is pond 5 (shown <br />below), which appeared to hold a modest amount of water. <br />The upper portion of the west downdrain of Fill 9 (shown below) needs some maintenance <br />work due to movement of riprap during heavy runoff events. Please complete this work prior <br />to the next spring runoff season. <br />Sediment markers were clearly visible in pond 7 and pond 9. Please ensure all ponds have <br />sediment markers established prior to the next spring runoff season.
