III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection of the Roadside Portals Mine conducted on December 3, 2009 by Mike <br />Boulay of the Division of Reclamation, Mining and Safety Grand Junction Field Office. Tonya <br />Hammond from Snowcap Coal Company (SCC) was present during the inspection. Weather <br />conditions were clear and cold and ground conditions were dry. <br />Processing Waste & Support Facilities <br />The main purpose of this inspection was to view the reclamation work that is underway at the UTL <br />area and at the temporary stockpile location at the CRDA-1. SCC is in the process of removing any <br />remaining coal and coal remnants from the UTL rail loop disturbed area and in accordance with the <br />approved reclamation plan they are hauling this coaly material to the temporary refuse disposal area <br />stockpile location atop the CRDA-1. The reclamation plan calls for removing coal and coal remnants <br />over the entire rail loop disturbed area, including ditches, sediment pond inlet areas, the SAE bermed <br />area along the toe of the rail outslope near the loadout structure, and any other locations where coaly <br />material has accumulated. SCC has also been given approval to dispose of coal mine waste from the <br />McClane Canyon Mine at the CRDA-1 stockpile. After all the coal waste has been unloaded on top of <br />the CRDA-1, it will then be placed and compacted in the access road that was left open for the <br />temporary stockpile. <br />SCC has made arrangements with Halliburton's contractor, Skyline Contracting, Inc. to do the coal <br />material cleanup and hauling to the CRDA-1. SCC is supervising the work. At the time of the <br />inspection a track hoe with a smooth blade was removing coal fines from the stockpile pad ramp at the <br />loadout. Three trucks were operating to haul the material to the CRDA-1 stockpile. One dozer was <br />also pushing coal material out of the storage tunnel and cleaning that area out. So far SCC has cleaned <br />coal material from the stockpile pad, storage tunnel, along the road/loop and road ditch. See the <br />attached photographs of these locations at the end of this inspection report. Approximately 3,500- <br />4,000 cubic yards of coal material has been removed and hauled. Very good progress has been made <br />and SCC is doing an adequate job of removing most of the coaly material. Small amounts or pockets <br />of coal fines cannot be feasibly removed without mixing in large amounts of non-coaly fill dirt. The <br />amount of coal material that will remain is minimal and these locations will be backfilled and graded <br />to cover the small amount of coal fines that cannot be adequately retrieved. <br />Areas that remain to be cleaned up include portions of the rail track, the area northeast of the loadout <br />building, and on the other side of the slope along the outer edge of the rail loop on the northeast side. <br />There is also a small area of coal cleanup inside the loop on the south side across from the construction <br />material stockpile that will have to wait until next spring. This location has rail track stacked here <br />from when Halliburton initially constructed the temporary sand loading pad site. The coaly material at <br />this location will be removed next spring after the rail has been replaced on the western end of the <br />UTL area.
