The Division conducted a review of the Stability Analysis Report submitted with this <br />exhibit and found the proposed setback area adequate. However, in accordance with <br />Rule 6.4.19 the operator is still required to submit evidence that an attempt was made <br />to reach an agreement with Weld County for the Poudre Trail and the fence. <br />Enclosed with this letter is a copy of the Divisions findings. <br />Attached is a copy of the agreement with Weld County for the Poudre Trail and the <br />fence. <br />We recognize that the decision date for this application is December 31, 2009. We are <br />hoping that this response adequately and satisfactorily addresses the Adequacy Review <br />#2 comments with the exception of J/26. Please review the attached information and let <br />me know if you have any questions or comments. We will provide you with a response <br />to comment J/26 as soon as possible and realize that due to the delay in us responding to <br />this comment, we may need to request an extension to the decision date. <br />I will be out of the office starting December 24, 2009 and will be back on January 4, <br />2010.
