III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the inspection. Comments also <br /> describe any enforcement actions taken during the inspection and the facts or evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Janet Binns of CDRMS. The mine no longer extracts coal,but the remaining <br /> surface pit(Pit B)is permitted to dispose of flyash. CEC caps,regrades,topsoils,mulches and seeds the pit as the ash fill <br /> progresses. The weather was mild and calm. The mine site was frozen with small patches of snow throughout the site. <br /> Present at the inspection were: Don MacDonald of Coors Energy Company,and Troy Swain of Weld County Department of <br /> Public Health and Environment-Solid Waste Division conducting an inspection as well. <br /> Signs and Markers: Mine ID sign at the access road entry on to the permit area remains intact and up to date. Permit <br /> boundary markers consist of white 3"metal pipe. Permit area boundary markers were observed along the East and North <br /> permit boundaries. The Division collected GPS data points of the NE and NW permit corners. <br /> Roads: CEC continues to remove road base material from the haul road return from the pit to the facilities. CEC does not <br /> rely on this travel corridor from hauling ash or spoil to the B-pit as the active area in the B pit progresses northward. Road <br /> side ditches along the haul road are in good shape. No problems were noted with the access or haul road. <br /> Hydrologic Balance: Pond#2 was dry with patches of snow. No problems were noted with this pond. The Dugout pond <br /> contained small patches of snow but no pool of water. CEC had submitted the Annual and 4 h Quarter pond inspection to <br /> the Division. The condition of the ponds are in agreement with the observations recorded in the report. <br /> Perimeter ditches to Pond 2 remain in good condition. <br /> Support Facilities: Oil and gas well development appear to be progressing. New locations have been flagged. Mr. <br /> MacDonald stated that the gas company is considering conducting directional drilling. This will reduce the number of pads <br /> required to be constructed,and minimize the number of access roads to the drill pads. However,each drill pad may be <br /> larger in area. CEC will permit these proposed disturbance areas with the Division once they are provided the detail by the <br /> gas company. Two proposed drill sites on the west side of the property are located outside of CEC's disturbed area but <br /> within the permit area boundary. Two proposed drill sites are located along the northern border of the property,outside of <br /> the permit boundary. Two proposed location are located within the permit boundary,on reclaimed areas, south of the haul <br /> road. <br /> Air Resource Protection: Four recent ash piles were located at the pit that will be dozed out. Spoil material has been spread <br /> up to these recent piles. Blowing of the ash was minimal and confined to the immediate area around the piles. CEC in <br /> placing ash on the upper bench.
