M. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Joe Dudash of the Colorado DBMS.Jim Kiger represented the <br /> operator during the inspection.The area received a recent snow fall of several inches.The road and facilities <br /> area were relatively clear of snow but several inches of snow remained on the grassy areas.The facilities area <br /> was very wet due to the melting snow. <br /> Roads <br /> The main paved haul road was partially wet from melted snow and was in good condition.There was no <br /> indication of fugitive dust being tracked onto the main highway. The east entrance road was snow packed.The <br /> east side entrance gate was open. <br /> Sins and Markers <br /> The mine identification signs were up at the main entrance,east entrance and along the railroad tracks.The <br /> required information was on each of the signs. <br /> Hydrology <br /> The east side sediment pond was completely covered in snow.The snow level in the pond was about three feet <br /> below the discharge level of the primary spillway. Culvert inlets and outlets,as well as the ditches,were <br /> covered in snow. <br /> Facilities <br /> There were no crushing/screening operations going on during the inspection.No haul truck unloading or rail car <br /> loading operations were in progress either. There was one small haul truck being loaded with coal for transport. <br /> There was a moderate volume of coal on the facilities bench.No fugitive dust problems were noted. <br /> There were no problems with any of the processing facilities as well.The substation area and the material <br /> storage area were covered in snow.There were no fuel leaks at the fuel facility. <br /> The outside berm of the facilities bench was snow covered but was in place and was functional. The outslope of <br /> the facilities bench was snow covered. <br /> Topsoil Stockpiles <br /> Both topsoil stockpiles were covered in snow.Topsoil signs were up. <br /> c:/word2007/terror/insp 1209 <br />
