M. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Joe Dudash of the Colorado DBMS.No one represented the operator <br /> during the field inspection.The entire mine site was covered in about 6 to 8 inches of snow.A snowmobiler had <br /> been on site. The"no trespassing"sign was up on the gate but the gate was open.The operator needs to make <br /> sure that the site is secure. <br /> Roads <br /> The paved entrance road was snow covered.Apparently,the snowmobiler had made a ramp out of snow on the <br /> road.The bridge across the river was also snow covered.A small one foot square board was missing on the <br /> bridge.The board may have been broken as a result of the snowmobiler riding across the bridge.This hole in the <br /> bridge should be repaired since it could be a walking hazard. <br /> Signs and Markers <br /> The mine identification sign was up on its post at the top of the hill. The required information was on the sign. <br /> The"records location"sign was also up on the same post as that of the mine id sign. <br /> Hydrology <br /> There appeared to be only snow in the sediment pond.The pond embankment was covered in snow but <br /> appeared to be stable.The gate on the primary discharge pipe was closed.The sediment pond's emergency <br /> spillway appeared to be functional. <br /> The hillside spring water treatment pond was covered in partially melted snow.The treatment pond was <br /> discharging at about 10 gpm into the river. The discharge water had the usual orange color.This orange color <br /> has been shown to be in compliance with water quality standards. <br /> The collection ditch leading into the sediment pond was covered in snow but appeared to have sufficient <br /> capacity.The riverside berm that protects the facilities area from flooding was also covered in snow but <br /> appeared to have enough height to be functional. <br /> c:/word200Wbear3/in sp l 209 <br />
