III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash of the Colorado DRMS. Bill Bear represented the <br />operator, Bowie Resources LLC. Bowie is currently longwall mining in the B-9 panel. After this panel is mined, <br />Bowie will be room and pillar mining until a new longwall mining plan to the west is approved. There had been <br />a recent snowfall in the area and several inches of snow remained on the ground. <br />Main Mine Site <br />The paved haul road was clear of snow and in good condition. The guard rail was in place. Most of the road <br />ditches were clear of snow and had sufficient capacity. There was no coal dust being tracked onto the county <br />road. The mine id sign was up at the entrance and surface disturbance markers were up around the site. <br />There was only a small volume of coal that was stockpiled on the D-seam portal bench. Cut and fill slopes were <br />stable and the bench's outside edge berm was in place. There were no problems with any of the coal handling <br />structures and there were no leaks at the fuel facility. The material storage area was well organized. <br />There were no problems at the B-seam portal bench. The highwall appeared to be stable and the concrete wall <br />on the outside edge of the bench was in place. The excess material stockpile across the road from the B-seam <br />portal bench was covered in snow. The main topsoil stockpile was completely covered in snow as well. <br />There was very little stockpiled coal on the coal stockpile bench at the bottom of the hill. The ditches and <br />culverts that bring runoff into pond B were covered in snow. The ice/snow level in pond B was below the <br />primary discharge pipe level. The float was on the primary discharge hose. <br />Coal Waste (Gob) Stockpiles <br />The coal waste pile haul road was frozen but clear of snow. The road ditches were filled with snow. Ponds C <br />and D were snow and ice covered. Except for the working area, the coal waste piles were essentially covered in <br />snow. At the working area in the middle of the coal waste pile area, the operator was mixing wet coal waste <br />with drier coal waste for better compaction. Although covered in snow, the coal waste pile outslopes appeared <br />to be stable. There was positive drainage off of the coal waste piles. The upland diversion ditches were covered <br />in snow. Pond F and its collection ditches were covered in snow as well. <br />Unit Train Loadout <br />The entire loadout bench and outslope were covered in about 4 to 6 inches of snow. There was no unit train at <br />the loadout. The mine id sign was up at the entrance. Pond J and pond K were covered in snow. Ditches and <br />culvert inlets and outlets were snow covered as well. The bench outslope appeared to be stable. There were no <br />indications of fugitive dust problems. <br />Hubbard Creek Fan Site <br />The road up the Hubbard Creek canyon was snow packed but passable. The entire Hubbard Creek fan site was <br />covered in 6 to 8 inches of snow, except for the entrance and a path to the fan facilities, which had been graded. <br />The fan was operating and had a reasonable level of noise. The mine id sign was on the entrance gate and <br />surface disturbance markers were up around the site. The upland diversion ditch was snow covered. <br />c:/word2007/bowie2/insp 1209
