These responses have <br /> been submitted in answer to concerns identified by the Division during 1994 mid-term <br /> review, (August 4, 1994). <br /> #2. 1994 Midterm Review requested that the operator update the permit to indicate <br /> results of the monitoring plan concerning the regraded overburden. <br /> Revised page 2.04-8 (September 1994) was submitted along with new pages to <br /> Exhibit 7; 7-32 through 7-52. As stated on page 7-32 two overburden samples <br /> exhibited unsuitabilities due to low pH and subsequent high Iron content. these two <br /> samples were pit 2 and pit 21. These locations were reworked and additional <br /> samples collected and analyzed (page 7-38 and 7-52). This reworking of the material <br /> brought these locations into suitability range in regards to the pH. Drawing 135-A <br /> was submitted along with the revised pages which defines the overburden sampling <br /> locations. This submitted information appears to address the Division's concerns. <br /> #4. In the 1994 Midterm Review the Division requested that the operator "clarify the <br /> sampling design for determining vegetation success and diversity in preparation for <br /> Phase I and Phase III bond release. ....[I]nclude methodology, statistical accuracies, <br /> and sampling techniques." <br /> The operator responded with submittal of revised pages 2.05-25, 26, 26i, 26ii, and 27. <br /> A. No changes were noted to page 2.05-25. This "revised " page is acceptable. <br /> B. Revised page 2.05-26 (September 1994) states when revegetation monitoring will <br /> occur, years 3,9,and 10 of the minimum 10 year liability period. Year 3 data will not <br /> be collected to adequacy and woody plant density will not be collected for <br /> revegetation success purposes since the Division, landowner, and Colorado <br /> Department of Wildlife have waived the requirement for woody stem re- <br /> establishment for this mining and reclamation permit. This is acceptable. <br />
