Harry, I have finally had an opportunity to review the vegetation and soils portions of
Technical Revision No. 5 as submitted by J.E.Stover and Associates. These responses have
been submitted in answer to concerns identified by the Division during 1994 mid-term
review, (August 4, 1994).
#2. 1994 Midterm Review requested that the operator update the permit to indicate
results of the monitoring plan concerning the regraded overburden.
Revised page 2.04-8 (September 1994) was submitted along with new pages to
Exhibit 7; 7-32 through 7-52. As stated on page 7-32 two overburden samples
exhibited unsuitabilities due to low pH and subsequent high Iron content. these two
samples were pit 2 and pit 21. These locations were reworked and additional
samples collected and analyzed (page 7-38 and 7-52). This reworking of the material
brought these locations into suitability range in regards to the pH. Drawing 135-A
was submitted along with the revised pages which defines the overburden sampling
locations. This submitted information appears to address the Division's concerns.
#4. In the 1994 Midterm Review the Division requested that the operator "clarify the
sampling design for determining vegetation success and diversity in preparation for
Phase I and Phase III bond release. ....[I]nclude methodology, statistical accuracies,
and sampling techniques."
The operator responded with submittal of revised pages 2.05-25, 26, 26i, 26ii, and 27.
A. No changes were noted to page 2.05-25. This "revised " page is acceptable.
B. Revised page 2.05-26 (September 1994) states when revegetation monitoring will
occur, years 3,9,and 10 of the minimum 10 year liability period. Year 3 data will not
be collected to adequacy and woody plant density will not be collected for
revegetation success purposes since the Division, landowner, and Colorado
Department of Wildlife have waived the requirement for woody stem re-
establishment for this mining and reclamation permit. This is acceptable.
