Stark December 18, 2009 <br />Colorado Division of Reclamation, Mining, and Safety <br />1313 Sherman Street - Room 215 <br />Denver, Colorado 80203 <br />(303) 866-3567 X8145 <br />Re: BTU Empire Corporation - Eagle 5 & 9 Mine Complex (Permit No. C-81-044), Minor Revision <br />(MR09-48) for Operator/Mine Name Change <br />Dear Mr. Stark: <br />BTU Empire Corporation (BTU-EC) requests CDRMS approval of a Minor Revision (MR09-48) to our <br />approved Permit, for a change in the operator/mine name for the Permit. The change in operator name reflects a <br />minor change to bring the permit information in-line with a recent corporate re-structuring, which established all <br />operating entities and land/reserve holding entities as limited liability corporations. The change in mine name <br />updates the mine designation to accomodate both historic and potential future operations. <br />This minor change in operator name results in a change in operator name from `BTU Empire Corporation" to <br />BTU Empire Company, LLC, and represents a change in name only, and not a change in ownership. The <br />change in mine name eliminates the historic designation of "Eagle 5 & 9 Mines", as not fully reflecting the <br />history of mining at this site, and replaces it with "Williams Fork Mines", which as a place designation is <br />intended to encompass both historic and potential future mining operations. With this revision submittal, we are <br />providing complete updated information under Rule 2.03, along with references in the introductions to each <br />permit section noting the change in operator name. To minimize the necessary changes in the PAP, we are <br />retaining the same name abbreviation (EC). In order to maintain all necessary bonds and insurance certificates <br />in full effect, changes to these instruments to reflect the new name will not be made until we receive notification <br />of CDRMS approval. At that time we will provide revised bond and insurance certificates reflecting the new <br />name, for you files. <br />This submittal includes revised PAP text and supporting materials, as identified by the Attached Summary of <br />Revisions and Additions.
