C-1981-022, TR-64
Second Adequacy Review
18 December 2009
OMLLC: As noted above, the revised Item 9 table also includes information for
TR-65. TR-65 includes Map 2.05-M1, Sheet 6 of 6 that shows LW-17-04 and
LW-17-01A. We recognize that the concurrent review of TR-64 and TR-65
presents some challenges with duplicate exhibits and information.
DRMS: Response noted; no further action is necessary.
3. DRMS: The column headings for Item 9 appear only on the first page. Please
revise the table to include the column headings on each subsequent page.
OMLLC: The column headings for the Item 9 table are now provided on each
page.
DRMS: Item resolved; no further action is necessary.
4. DRMS: Page 2.05-31a, Paragraph E - Degasification Well Roads references
Exhibit 2.04-E3, Item 6 - Methane Drainage Well Information. This information
is presented in Item 9. Please revise this page accordingly.
OMLLC: Page 2.05-31a, Paragraph E - Degasification Well Roads has been
corrected as requested.
DRMS: Item resolved; no further action is necessary.
5. DRMS: The USFS Paonia Ranger District submitted comments in a letter dated
10 November 2009. Please note that the USFS requires additional information
regarding the application. In addition, as you are aware, the proposed activities
lie within an inventoried roadless area. The Division will be unable to issue a
decision to approve TR-64 until these issues are resolved to the satisfaction of the
USFS. If any changes to the permit are necessary as a result of responses to
comments made by the USFS, please revise the permit application accordingly
and submit the revisions to the Division.
OMLLC: The USFS has requested information regarding whether our proposal
is consistent with conditions found in the Federal Coal Lease and whether Oxbow
requires any relief from the lease stipulations. In particular, they requested any
information addressing operations on steep slopes, geologic hazards or any
addition information regarding drilling fluids. Attached is a December letter
addressing the questions from the USFS. Oxbow does not believe our comments
to USFS will require a change to the C-1981-022 Permit application, nor will we
require any relief from Lease Stipulations.
DRMS: This item remains un-resolved, awaiting response from the USFS to
Oxbow's 9 December 2009 letter.
