Cattany <br />Division Director <br />Re: Foidel Creek Mine, C-82-056, Third Quarter 2009 Coal Waste Pile Inspection Report Natural Resource Trustee <br />Dear Mr. Nettleton: <br />The Division received Twentymile Coal Company's (TCC) Third Quarter 2009 Coal Waste Pile Inspection <br />Report on October 6, 2009 via e-mail. The report was prepared by North West Colorado Consultants <br />(NWCC) for Twentymile Coal Company. Compaction tests were conducted on August 3, 2009, and <br />September 9, 2009. <br />NWCC visited the site on September 28, 2009 and conducted an inspection of the refuse disposal area (RDA). <br />No problems were noted in the engineer's report with regard to the construction, grading, drainage, or <br />operation of the pile. Based upon TCC's reported throughput of coal through the wash plant, the engineer <br />approximated that 303,165 to 269,480 tons of coal refuse was added to the RDA during third quarter 2009. <br />TCC provided Nuclear Density Test results in the report as well. Compaction specifications were achieved <br />for all 8 sample locations. No maps or sketches of the refuse area or compaction test locations were provided <br />with this report. Please submit a sketch or map of the compaction test locations for first, second, and third <br />quarters of 2009. <br />Results of monitoring of 5 piezometers were included in the report. Water levels reported for 4 of the 5 <br />piezometers remain consistent with previously reported trends. The piezometer 5MW has been damaged and <br />no measurement was recorded.
