Box 467 Division Director <br />Golden, CO 80402 Natural Resource Trustee <br />Re: Keenesburg Mine, Permit No. C-1981-028, Fourth Quarter 2009 Sediment Pond Inspection Report <br />(Rule 4.05.9(17) and Annual Inspection (Rule 4.05.9(14)(a)) <br />Dear Mr. MacDonald: <br />The Division has reviewed Coors Energy Company's Fourth Quarter 2010 Sediment Pond Inspection report. <br />CEC's fourth quarter 2009 sediment pond report was received by the Division on December 16, 2009. <br />Sediment pond inspections were conducted by CEC on December 10, 2009. <br />No problems were noted for any of the impoundments in the report. No discharge from any of the ponds <br />was reported. CEC noted that there was some minor burrowing in the sidewalls of the dugout pond. An on- <br />site inspection of the dugout pond on December 17, 2009, found that the visible burrows were well above <br />potential waterline in this pond. This pond is incised with the burrows located in native ground, and do not <br />pose a safety concern. Wildlife habitat is a post-mining land use for this area, so small animal burrowing in <br />the area is not a concern. The observations noted in CEC's fourth quarter inspection report agree with the <br />Division's on site observations. This report meets the requirements of Rule 4.05.9(17). <br />This report has also been reviewed by a professional engineer representing Coors Energy Company. This <br />report meets the requirement of Rule (Rule 4.05.9(14)(a)).
