Section 4.02.3 of the Board's Regulations states, "The perimeter of a permit area for surface coal mining <br />activities, or in the case of underground mining activities, the perimeter of all areas affected by surface <br />operations or facilities, shall be clearly marked before the beginning of surface coal mining operations". The <br />Division interprets this regulation to mean that perimeters of surface areas approved by DRMS to be <br />disturbed by surface activities related to underground coal mining must be clearly marked before those <br />activities begin. <br />Section 4.02.4 of the Board's Regulations states, "Signs and markers shall be maintained during the conduct <br />of all activities to which they pertain". We interpret this regulation to mean that the perimeter markers <br />required by Section 4.02.3 must be maintained in place until those marked surface areas are released from <br />the Division's regulatory jurisdiction. <br />Should the Division determine at our next on-the-ground inspection of the Deserado Mine that surface areas <br />at the mine subject to Sections 4.02.3 and 4.02.4 of the Board's Regulations are not in compliance; please <br />understand that Division enforcement action may result.
