Dear Ms. Sartori:
Your letter dated September 4, 2009 and the additional information submitted on November
25, 2009, requesting renewal of the above referenced substitute water supply plan to cover
depletions caused by an existing gravel mining operation have been reviewed. The required fee of
$257 for the renewal of this substitute water supply plan has been submitted (receipt no. 3642551).
The original plan was approved on March 26, 1993 and was most recently renewed on October 7,
2008.
Plan Operation
As indicated in the previous approval letter, Connell Resources, Inc. ( "CRP') has begun the
process of backfilling this site above the groundwater table to remove the long -term augmentation
requirement. In a letter dated April 23, 2003, the State Engineer's Office allowed the site to be
operated under a substitute water supply plan until such time that the pit has been completely
backfilled. Connell Resources, Inc. has amended their DMG permit to reflect that the groundwater
pond will be backfilled completely. According to the information provided, backfilling of the site
restarted again in August 2008. The additional information submitted on November 25, 2009
indicated that the backfilling of the site continued into 2009 reducing the exposed surface area from
6.4 acres to 4.2 acres. Note that all ground water at this site was exposed after December 31, 1980.
Please note that the approval of this substitute water supply plan does not relieve the
Applicant and /or the landowner of the requirement to obtain a water court decree approving
a permanent plan for augmentation or mitigation to ensure the permanent replacement of all
depletions, including long -term evaporation losses and lagged depletions after gravel mining
has ceased. In the previous plan we indicated that renewal of this plan is contingent on the
Applicant demonstrating that the backfilling of the site has continued or contingent upon the
Applicant filing an application for a plan for augmentation with the Division 1 Water Court
that includes long -term evaporation losses at the G. L. Pit site. Based on the recent
information provided, it was determined that the Applicant has satisfied the above
requirement.
