The . mining map does not indicate the direction of mining (such as arrows, for example). Please show the direction of <br />mining. <br />The mining map does not clearly show whether will be excavation up to the permit boundary, or if there will be an <br />unmined setback to facilitate haulage around the pit, or the land needed for cut and fill slope reduction, etc. Please <br />revise the map to show the planned extent of the excavation area if it is different from that presently depicted. <br />The mining map includes arrows indicating the location of the topsoil stockpiles, product stockpiles, etc., but the map <br />must also include an outline of these features. Please provide a revised map that includes these items. <br />The reclamation map shows an undulating line related to the pond margin, but it not clear what it represents. Please <br />clarify this on a revised map that shows the crest (top) of the slope, the full slope area, and the waterline of the pond. <br />The revised map must include the direction and rate of slope, so please indicate the gradients of the pit slopes and the <br />unmined areas. <br />The natural Swale or drainage outlet in the southern end of the site is not shown on either map. Please show this <br />feature on the revised map(s). <br />Exhibit F — Other Permits and Licenses (Rule 6.3.6) <br />If the pond may be occasionally dewatered, with the water to be pumped offsite (outside the 6.4 -acre permitted area) <br />please ensure that you inquire to the Water Quality Control Division, at the Colorado Department of Public Health and <br />Environment (WQCD /CDPHE) concerning a discharge permit. This is the same agency that issues stormwater <br />management permits. <br />Exhibit L — Permanent Manmade Structures (Rule 6.3.12) <br />As mentioned above, there is no description of the fences in the application. Such descriptions, including their <br />ownership, may be included here or under Exhibit B, above. <br />There are gas well facilities that exist within 200 feet of the northern terminus of the new road. The new road is part of <br />the permitted area, and the haul route crosses the well pad. Please provide the information required under this rule, <br />especially including ownership, and a damage agreement, as specified in the rule. <br />Addendum 1 - Notice Requirements (Rule 1.6.20)(b)) <br />Please provide proof of mailing notification to the landowner (even though it is the same entity as the permit <br />applicant). <br />Other Items <br />Please provide proof of publishing the legal notice by providing the newspaper page or a notarized affidavit from the <br />publisher. <br />All written materials that you provide in response to this review letter must be additionally filed at the Archuleta <br />County Clerk and Recorder. Please obtain a receipt for filing this material, and provide the receipt to this office. <br />The Division's decision date for the application is currently set for December 17, 2009 Please provide your responses <br />prior to the decision date to allow time for their review. If additional time is required to prepare and submit these <br />materials, you may request an extension. The extension request must be written, and include a specific date or length <br />of time. <br />The information you provide should be clear and complete, partly since it will be used to estimate the bond amount. <br />After the application is found adequate for approval, a bond estimate will be sent to you.
