There are several items <br />that must be clarified or corrected before we may consider an approval decision. These items are listed below in the <br />order of the application exhibit to which they pertain. This information is needed pursuant to the rules and will be <br />important to estimate the bond amount. Please respond to all items, and label them to facilitate their inclusion in the <br />permit file. Portions of the application not referenced in this letter are considered to be adequate at this time. <br />Application Form, Item 5 <br />The description of commodities and incidental commodities to be excavated at the site does not include topsoil, though <br />an excess of it will be generated and presumed to be removed from the site. Please include topsoil in the appropriate <br />blank(s) of this portion of the application. <br />Exhibit B — Site Description (Rule 6.3.2) <br />The exhibit does not include the new fence along the eastern edge of the pit area. It is not clear if it will be a <br />permanent feature (e.g., remain after reclamation) but it should be noted in the site description. The segments of the <br />old fence that were observed on or near the southern and southwestern boundaries should likewise be included. <br />The proposed permitted area includes 1.6 acres of new roadway. Its northern terminus is within 200 feet of an existing <br />gas well facility, but no information is provided about the well. Please include the required information in this exhibit. <br />(Further items concerning the well are included in following paragraphs.) <br />Please clarify the depth (or seasonal range of depths) to the expected water level of the pond. <br />The map does not depict the stand of mature cottonwoods that exists on or near the western edge of the site. The small <br />pre -law pit that was observed in the south end of the site is also not shown or described. Please provide a revised map <br />that depicts at least the estimated locations of the margin of the cottonwoods and the old pit. <br />There is a natural Swale or drainage outlet for the low bench area proposed for this pond. It was observed to be <br />adjacent to the old pit that exists in the southern end of the site. The application does not include description of this <br />feature, though it is considered important due to the shallow topography of the site and its relation to the river <br />elevation.
