<br />Bond release application SL-06 was approved on December 9, 1999 for Phase I, II and III Bond <br />Release of $663,590.00 for reclamation work in the upper facilities area of the permit. The <br />bond required for remaining reclamation work was reduced to $4,304,027.00. <br />Bond release application SL-07 was approved on January 5, 2000 for a Phase I Bond Release of <br />$464,143.00 for reclamation work in the support facilities area of the permit. The bond required <br />for remaining reclamation work was reduced to $3,839,884.00. <br />Bond release application SL-08 was approved on December 19, 2003 for Phase I, II and III <br />Bond Release of $440,237.00 for reclamation work at the hill-slope conveyor, Goat Trail, and <br />P&M portion of lower facilities area of the permit; and for $327,686.00 of demolition of <br />structures (Phase I) in a 3.3 acre area of the lower facilities area. The bond required for <br />remaining reclamation work was reduced to $3,071,961.00. <br />Bond release application SL-09 was approved on June 1, 2005 for Phase I, II and III Bond <br />Release of $226,163.00 for reclamation work applicable to the areas of the 3.3 acre area for the <br />gravel pad, entrance and access road and the vegetated southern portion of the lower facilities <br />area. <br />Items Approved for Permanent Retention <br />The Old Tipple Access Road was requested by the surface owner of the property to remain as <br />a permanent feature to allow access to the lower portion of the surface owner's property. <br />The Old Tipple Access Road is also used for construction access and maintenance of power <br />transmission lines owned by Yampa Valley Electric. Culverts to be retained in association <br />with this road include: TA-6, TA-8 and TA-9. An office building with graveled parking <br />areas and facilities, including a well and a septic system, the entire length of the Old Tipple <br />Access Road with the north end gate, and all sediment control structures between the Old <br />Tipple Access Road and the railroad tracks were approved as permanent in Technical <br />Revision 45 in 2006. <br />Submittal of Bond Release Application and Completeness Determination by the <br />Division <br />The Division received Chevron Mining, Inc.'s bond release application SL-10 on November <br />25, 2008. The application was found complete on January 5, 2009, after the Division <br />received proof of publication of the applicant's public notice. The completeness <br />determination was made in accordance with Section 3.03.2(1)(d). <br />Chevron Mining, Inc. submitted the bond release application following the procedures <br />described in the Act and Regulations.
