<br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />General Comments <br />This was an aerial inspection covering most permanent program portions of the reclaimed Seneca II mine site. <br />12 oblique aerial photos were taken by Harry Ranney of the Division on the morning of November 19, 2009. The <br />digital images were viewed by Dan Mathews of the Division on November 24, 2009. Weather appeared to be <br />clear at the time of the flight. Ground conditions ranged from approximately 90% snow covered on slopes with <br />primary north and east exposures, to approximately 20% snow cover on slopes with primary south and west <br />exposures. Snow cover appeared to range from a skiff to less than six inches where present. <br />Photos included good views of the Pecoco Pond, Sediment Ponds 002, 004, and 008, the shop facilities area, <br />East Wadge Area, and more distant views of most reclaimed slopes and a number of permanent drainages in <br />the permanent program areas. There was no activity evident. Ponds 004 and 008 appeared to be iced over, <br />while Pecoco and Pond 002 appeared to be open. Two stock ponds along the PM-11 drainage J20 and T17) <br />were iced over. No slide features or areas of excessive erosion were evident. Drainage and sediment control <br />facilities appeared to be functioning properly, to the extent that could be determined from the aerial images. <br />No problems were noted. <br />3
