III. COMMENTS - COMPLIANCE
Below are comments on the inspection. The comments include discussion of observations made
during the inspection. Comments also describe any enforcement actions taken during the inspection
and the facts or evidence supporting the enforcement action.
General Comments
This was an aerial inspection covering disturbed areas within the mine pits portion of the Yoast permit area. 18
oblique and near digital photos were taken by Harry Ranney of the Division during the flight on 11/19/09, and
the images were viewed by Dan Mathews of the Division on 11/25/09. Weather appeared to be clear at the time
of the flight. There was solid cover of fresh snow(with the exception of steep south facing slopes), which made
detailed observations difficult.
Photos included views of Sediment Ponds 010, 012, 012A, 013, and 014, as well as Stock Ponds 011A and ST-
1. All of the ponds contained pools that were frozen over, with the exception of 012A and ST-1, which were dry.
Pond embankments appeared stable.
The only activity evident from the photos was dozer grading along the ridgeline northeast of Pond 012, east of
and up-slope from the Pond 012 slide zone. The grading activity is presumed to be in association with a
revision recently approved by the Division, addressing grading along the ridge disturbance to direct runoff away
from the slide, along with installation of sediment control structures (staked straw wattles or similar siltation
control product), for small area exemption(SAE)sedimentation control.
t
Tu.
mod.
 — -Oat ,
1 +
.T
Dozer grading and staked siltation control wat les.
3
